2. You ("Subscriber") agree to pay all charges incurred by your account in accordance with the terms and prices contained in the ECSIS.NET, LLC. Rate Schedule then in effect. By accessing the Service you reaffirm your authorization to ECSIS.NET, LLC. to secure payment in accordance with the method of payment you have selected.

3. THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. NEITHER ECSIS.NET, LLC., ITS EMPLOYEES, INVESTORS, AGENTS, SUBCONTRACTORS NOR ITS INFORMATION PROVIDERS WILL BE LIABLE TO YOU FOR ANY DAMAGES, INCLUDING LOST PROFITS OR LOST SAVINGS OR OTHER INCIDENTAL OR CONSEQUENTIAL DAMAGES, ARISING OUT OF ACCESS TO, OR INABILITY TO GAIN ACCESS TO, THE SERVICE.

4. Subscriber's right to access the Service is not transferrable and is subject to any limitations heretofore or hereafter imposed by ECSIS.NET, LLC., in its sole discretion. Subscriber agrees that they are over the age of eighteen (18), and that Subscriber is solely responsible for any use of the account or Service by persons under the age of eighteen (18).

5. ECSIS.NET, LLC. will give reasonable notice of all planned system upgrades and system maintenance procedures that may result in service interruptions. ECSIS.NET, LLC. will not be responsible for damages or losses suffered due to service interruptions. Subscriber agrees to indemnify ECSIS.NET, LLC. for all claims, damages, liability, cost, and expense incurred by ECSIS.NET, LLC. and arising from any and all uses by Subscriber of the online products and services provided by ECSIS.NET, LLC.. ECSIS.NET, LLC. reserves the right to change without notice services not explicitly described in Paragraph 1 above, including, but not limited to, services offered, access procedures, and documentation.

6. ECSIS.NET, LLC. reserves the right to suspend or terminate Subscriber's account upon any breach of these terms and conditions or its Acceptable Use Policy (AUP) by Subscriber, including, but not limited to, failure to pay for services, delinquent payments, rejection of credit card authorization or charges, disputed credit card charges and returned checks. Subscriber shall pay, in addition to all other charges assessed hereunder, a fee of $20.00 for all returned checks. In the event of Subscriber's failure to timely remit payment in full of its current account charges, ECSIS.NET, LLC. shall be entitled to immediately terminate Subscriber's further use of and entitlement to the Service and to collect the entirety of Subscriber's account charges then existing plus court costs and attorneys' fees.

7. Subscriber shall not engage in any commercial or other use for profit of the Service except as specifically agreed to by ECSIS.NET, LLC. (I.E. Business accounts, WEB page services contracted with ECSIS.NET, LLC., Business Ads with ECSIS.NET, LLC., etc). Likewise, Subscriber shall not utilize the Service for any unlawful activity or purpose or for the publishing or display of any lewd, obscene, or offensive materials or information. Additionally, Subscriber shall not engage in or allow multiple logins utilizing Subscriber's account nor shall Subscriber engage in unattended processes (including email utilities, ping, irc bots, ftp services, WWW services, etc.). ECSIS.NET, LLC. reserves the right to immediately terminate the service of any Subscriber acting in violation of the above.

8. From time to time ECSIS.NET, LLC. may modify these terms and conditions and give Subscriber notice through publication on ECSIS.NET, LLC. and through individual electronic mail. Subscriber's continued use of the ECSIS.NET, LLC. five days following Subscriber's notice of such modifications shall evidence Subscriber's acceptance of all such modifications.

9. This agreement shall be governed by the laws of the state of Tennessee. Jurisdiction and Venue of any litigation filed in connection with this agreement shall be the Tennessee State Courts for Dyer County, Tennessee.

10. This agreement, as modified from time to time by ECSIS.NET, LLC. as set forth above, shall constitute the entire agreement of the parties.
